Forfeiture Applications

Under section 303Z14 of the Proceeds of Crime Act, an application for an Account Forfeiture Order can be made. 

Section 303Z14 Proceeds of Crime Act permits the Court to make a Forfeiture Order if it is satisfied that the money held in the frozen bank account or part of it:

(a) is recoverable property, or

(b) is intended by any person for use in unlawful conduct.

Forfeiture Proceedings frequently involve complicated concepts and the case law surrounding this area is nuanced and highly technical. It is therefore important to instruct lawyers who are experienced in this field of work and have a detailed knowledge of the law.
