What is a Grant of Probate and why do I need one?

Probate is a Court Order giving authority to the Executor appointed in a Will to collect in and distribute the assets of a deceased person. It confirms that the Will is legal and valid. It will be needed to sell a property in the estate and for other types of assets. A similar Court Order has to be obtained where the deceased left no Will (intestacy). Our Solicitors offer a friendly and efficient service to obtain Probate. We can also advise on and calculate any tax due in an estate and help set up trusts created by a Will or on Intestacy. I signed an Enduring Power of Attorney some years ago do I now need a Lasting Power of Attorney?

It has not been possible to create any new Enduring Powers of Attorney (EPA) since 2007 when the Mental Capacity Act replaced them with Lasting Powers of Attorney. EPAs may still be valid but if not, we can assist with making a Lasting Power of Attorney (LPA). LPAs have to be registered with the Office of the Public Guardian before they are used irrespective of lack of mental capacity. We can help assess whether a person is able to make a Lasting Power of Attorney and if not, we can assist with making a Deputyship application to the Court of Protection. We can also help with registration of an existing Enduring Power of Attorney which is necessary when the donor is losing their capacity.
